The Milanese Gallery has the main objective of promoting art and increasing the visibility of the Artist and his works for sales, in the Italian and  international and commercial exploitation of digital images of works of art through our website, accessible at www.galleriamilanese.com  (the "Site") or mobile application, including  other advertising platforms (facebook, instagram and TV) or partner sites.  The Milanese Gallery seeks to promote a variety of artistic styles (painting, sculpture, photography, drawing, illustration) through specialized curators. The only requirement to be present is to have talent and a truly artistic vision.

 

We recommend that you read the following Terms and Conditions carefully  and our Privacy Policy, which can be found at www.galleriamilanese.com Privacy Police . These Terms, the Privacy Policy and any other policies linked herein regulate the access and use of the Services and constitute a binding legal agreement between you and Galleria Milanese.

  1- It is assumed that , by including the work on the GALLERIA MILANESE website, the Artist expresses his intention and declares the right to sell it as well as having the work for immediate delivery.  

2-The artist must provide very safe packaging for his work.  There  MILANESE GALLERY  cannot be held responsible for damage to original works during transport. Consult and follow our guidelines  contained in the " PACKAGING INSTRUCTIONS "   on how to pack safely  for shipping.

3- AFTER THE PURCHASE ORDER

After the purchase order and subsequent payment by the customer, the work will be shipped within a maximum period of three days (except for adverse conditions that prevent this procedure).  

If the Work is no longer available, an email informing the Buyer will be sent within 48 hours, canceling the order.

4-SHIPPING OF THE WORK

See below for information on the steps required for your work to reach the collector safely. These steps include:

Schedule a date to pick up sold artwork. Galleria Milanese will send the CAR LETTER of the  collection of the work. The shipment must take place within 2-3 days from the date on which the collector purchased the work.

Read the sequence we have prepared carefully to make sure you know how to properly pack your shipping art.

All original works are sent to the collector directly  by the artist.

The delivery of the Works is carried out at the address indicated in the order summary form, during working hours and in the manner prescribed by the carrier chosen at the time of the order.

 

Immediately after the sale of the work, Galleria Milanese will send the waybill and the artist will have to print and paste it on the package. 

- Within the NATIONAL (throughout Italy) shipping is free, therefore the shipping cost must be previously added to the price of the work to be published for sale. In other words, the cost of shipping to Italy is already included in the price of the work on the site.

- In terms INTERNATIONAL, the customer will pay the shipping cost. The customer can choose the courier of his choice (listed on the site) as he will pay the shipping costs.  It will be paid by him at the time of purchase of the work. 

In both cases, if the recipient is not at the address to receive the work, it must be collected from the courier's warehouse within 3 days from the first attempt and if it is not collected within this period, the user must pay the return costs. .

You, the artist, will be responsible for packing your art for shipping, as well as all packaging costs.

 

5-CERTIFICATE OF AUTHENTICITY

When preparing your work for shipment, you must include a CERTIFICATE OF AUTHENTICITY  inside the package to be sent to the collector who purchased the work. The Certificate of Authenticity  will be sent to you, via  e-mail, from the Milanese Gallery. You print, sign and send along with the job.

Please note that transit time may vary depending on the customer's location. You will see your shipment's tracking number on the label provided by the shipping company. You can track using this tracking number directly on the carrier's website.

6-PAYMENT

At the time of purchase, the customer will pay on the Galleria Milanese website and within a maximum period of 30 days the artist will receive the payment, net of a 10% commission  (ten percent)  of the value of the work.

7-RETURNS AND REFUND POLICY

 

ORIGINAL WORKS

LA GALLERIA MILANESE is committed to guaranteeing 100% satisfaction from our art collectors!  Here because,  the returns policy  of the Milanese Gallery  allows you  to return the purchased item. Upon receiving an original artwork, we will give you seven (7) days to decide whether or not you wish to keep the artwork or return it for a refund.  

Any eligible artwork can be returned as long as it is returned to the artist in its original condition and packaging.

If you receive the product and renounce the purchase, you have the possibility to return it within 7 calendar days of receiving the order, with a refund of 100% of the value of the work in question.

Returns are allowed:

1- If the work is different from the one purchased by the customer.

2-If the work is damaged.

* Products whose packaging will not be accepted  it has been opened and redone.

* Products without a certificate of originality in perfect condition will not be accepted.

* Products with damaged or unusable protective packaging or with instructions for use will not be accepted.

* Exchanges of products purchased through promotions or coupons / discount coupons will not be accepted as part of the payment.


How do I return an original work?

From the moment you receive your original artwork from our couriers, you have seven (7) days to  or return the work in its original condition for a refund.  

We also require that  the returned work is sent by the buyer within three (3) days from the confirmation of the return of the work. So, if you receive a work of art that you have purchased from  Galleria Milanese and you are not completely satisfied, you have:

Three (3) days to contact us regarding your intention to return the work.
Three (3) days from the day you contacted us to ship the artwork.
  Do not send the work before contacting us; you must contact us first.

If you do not notify us of your intention to return the work within 3 days of receipt or do not ship the work within 3 days of notification, you will not be entitled to a refund. (Some exceptions apply. Contact us for an assessment of your specific situation. ) GALLERIA MILANESE reserves the right to make decisions in its sole discretion.

 

What to do if the artwork arrives damaged

- Within three  (3) days from the date of delivery of the goods,  send an e-mail to info@galleriamilanese.com to communicate order information.  Take photos of damaged images and packaging. Send these photos by e-mail to info@galleriamilanese.com.   Save the original packaging.

A representative  della Galleria Milanese will contact you to help you in the next steps.

GALLERIA MILANESE will in no case be held responsible for the non-compliance by the Buyer, who has the right to lodge a complaint against the delivery service provider. The Buyer must, as soon as he receives the order, check the conditions of the work of art, and immediately and in writing inform GALLERIA MILANESE that he will transfer it to the Courier.

8-The works published on the site are not exclusive.  The works can be published on other portals and be on display for sale in any physical gallery.  When the work is sold by the artist and not through this website, in this case the artist undertakes to immediately inform Galleria Milanese, in order to exclude the work from the website.

9-During the period of publication on the site, the works remain "at home" of the painter who can dispose of them for any exhibition activities.

10-The Artist undertakes to communicate the updating of the data entered in his registration ("Personal data" or others)  when necessary.

11-The Artist authorizes the publication and dissemination of his works (painting, sculpture, photography, drawing, illustrations) on the GALLERIA MILANESE website, on the internet, TV, partner website  and on other social media, with the sole purpose of promoting the sale and giving visibility to the Artist.

12-The artist guarantees, assuming all related responsibilities, that he is the exclusive owner of the rights to explore and economically exploit the works displayed on his page on the GALLERIA MILANESE site, exempting the site  from any responsibility in this regard.  It undertakes to protect the GALLERIA MILANESE and the Buyer in the event of any action brought by a third party on the transferred work, as part of the guarantee of silent possession. At the time of sale, the Seller assigns to the Buyer the material substrate of the artwork and its representation rights over the artwork. However, the Seller retains its moral right over the work of art as well as the rights regarding its reproduction.

13-The artist may at any time cancel his registration and withdraw without any penalty or fine, as long as the sales operations in progress are concluded.

14-From the moment in which the Artist publishes on this site or the customer accesses the services, he tacitly accepts all the Terms and Conditions of operation.

The unconditional acceptance of full general conditions of sale is mandatory to conclude the sales contract, both by the Seller and the Buyer. Acceptance is confirmed by a box that must be checked in the order form of the work of art.

15-GALLERIA MILANESE reserves the right, at its sole discretion, to modify, interrupt or terminate the Services or to modify these Terms, at any time. If we change these Terms, we will post the change on the Services or notify you of the change. We will also update the "Last Updated Date". By continuing to access or use the Services after we have posted a change on the Services or have provided you with a change notice, you are indicating that you agree to be bound by the changed Terms.  If the modified Terms are not acceptable to you, your only option is to stop using the Services. We encourage you to check back regularly to review these Terms and Conditions.  

16– FORCE MAJEURE In the event of a situation of force majeure, the execution of the contract may be suspended or, if completed, lead to the cancellation of the sale. Expressly, cases of force majeure or fortuitous events are considered, those usually recognized by the jurisprudence of the courts and tribunals, that is, an event that is beyond the control of the debtor, which could not reasonably have been foreseen at the time of the contract being concluded. and whose effects cannot be avoided by any Measures.  The party invoking the Force Majeure must immediately inform the other party, as well as about its termination.

Immediately after the sale of the work, Galleria Milanese will send the Waybill (documents for dispatch) and the artist must print it and paste it on the package.

- In the NATIONAL area (throughout Italy) shipping is free, therefore the shipping cost must be previously added to the price of the work to be published for sale. In other words,  the price of the work on the site is already included  inthe cost of shipping in Italy.

-  Internationally, the customer will pay the shipping cost. The customer can choose  the courier of his choice (listed on the site) as he will pay the shipping costs.  Itwill  be paid by him at the time of purchase of the work. 

In both cases, if the recipient is not at the address to receive the work, he must withdraw it from the carrier's deposit within 3 days after the first attempt and if it is not withdrawn within that period, he must pay the return costs.

You, the artist, will be responsible for packaging your art for shipping, as well as all packaging costs.
